Basement finishing and legal suites in Hamilton
A finished basement and a legal secondary suite in Hamilton run into the same ceiling-height wall eventually. A secondary suite needs a ceiling no lower than 1.95 metres, or 1.85 metres directly under a beam or duct, and the code requires that taller zone to connect all the way to the exit, not just sit somewhere in the middle of the room. It's a finished-floor-to-finished-ceiling measurement, after the subfloor and drywall go in, which is why a basement that looks tall enough before the build starts can come up short by the time it's actually done. In Hamilton's older housing stock, roughly a third of the city predating 1960, that shortfall is common enough to plan around from day one, with underpinning as the structural answer where the existing height won't clear it.
Hamilton bedrooms below grade need an egress window of at least 0.35 square metres with no side under 380 millimetres, full stop. A concrete foundation in contact with the ground is a moisture source by nature. Bulk water from a crack gets solved by digging up the outside and adding a membrane; vapour passing through sound concrete gets solved from the inside, with insulation that stops warm air reaching the cold surface behind it. Hamilton's own permit list treats waterproofing, weeping tile, and sump pump work as building-permit items in their own right, which is unusually strict and worth knowing before assuming a quick fix needs no paperwork.
Financing a suite got easier in January 2025, when a federal refinance program opened up to 90 percent of post-renovation value, up to two million dollars, specifically for a self-contained suite, provided CMHC approves the insured portion before construction starts.
